Forcible

Forcible sex offences apply to those who have been convicted of rape. Rape is considered any type of penetration, against the will of the person who is being raped. This can be with anyone.

Relatives, strangers, and married couples can all fall under this rule. Forcible can often be considered by many to be the worse of the two situations, but any type of sexual offence is serious.

This is not true; statutory rape is not forced at all. It's when someone performs sexual acts with another who is under the age of the law. Even if the younger person is consenting, it's still statutory rape, and a criminal sexual offense.

This same principle applies to those who are not in the mind or place to make a conscious decision about sex, and therefore cannot consent. This includes the mentally incompetent. Because they're not able to understand the ramifications of what they're doing, a sexual offense is involved.
